Terms of Service

1. Acceptance of Terms

By accessing and using Vimu ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use the Service.

Age Requirement: You must be at least 18 years old to use this Service. If you are between 13 and 18 years old, you may only use the Service with the consent and supervision of a parent or legal guardian. By using the Service, you represent that you meet these age requirements.

2. Description of Service

Vimu provides AI-powered video generation services that allow users to create videos using artificial intelligence technology. The Service operates on a credit-based system where users purchase credits to generate videos.

3. User Accounts

To use the Service, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and complete registration information
  • Notifying us immediately of any unauthorized use of your account

4. Credits, Payments, and Refunds

Credit System:

Credits are the currency used to generate videos on our platform:

  • Credits can be purchased through our payment processor (Stripe)
  • Credits do not expire and remain in your account until used
  • Video generation costs vary based on video type, resolution, duration, and AI provider
  • Credit costs are displayed before you confirm video creation
  • We reserve the right to adjust credit pricing with 30 days notice

Automatic Refunds:

Credits are automatically refunded in the following cases:

  • Video generation fails due to technical errors on our part
  • Video generation is blocked by content moderation and you did not violate policies
  • Service errors or provider failures prevent video completion
  • You cancel a video job before processing begins (queued status only)

No Refunds:

Credits are non-refundable in the following cases:

  • You are dissatisfied with the quality of generated videos (AI output varies)
  • Your request is blocked due to content policy violations
  • You no longer wish to use the Service
  • You purchased the wrong package (all sales are final)

Note: EU consumers may have additional refund rights under local consumer protection laws. Contact us to discuss if applicable.

5. Acceptable Use and Prohibited Content

You agree to use the Service responsibly and in compliance with all applicable laws. You agree NOT to use the Service to create, upload, or distribute:

Strictly Prohibited Content:

  • Deepfakes and Impersonation: Non-consensual deepfakes, unauthorized use of real people's likenesses, or content intended to impersonate, deceive, or defame individuals
  • Non-Consensual Intimate Content: Sexually explicit or intimate content depicting real people without their explicit consent (violates federal law including the TAKE IT DOWN Act)
  • Copyrighted and Trademarked Content: Videos featuring copyrighted characters, brands, logos, or trademarked content without proper authorization
  • Illegal Content: Content that violates any local, state, federal, or international law, including but not limited to child exploitation, terrorism, or incitement to violence
  • Hateful or Discriminatory Content: Content promoting hate speech, violence, or discrimination based on race, religion, gender, sexual orientation, disability, or other protected characteristics
  • Misleading Political Content: AI-generated content intended to mislead voters or interfere with elections without proper disclosure
  • Harmful or Dangerous Content: Content promoting self-harm, dangerous activities, or instructions for illegal activities
  • Spam or Malicious Content: Phishing, scams, malware distribution, or spam

General Usage Rules:

  • Do not interfere with or disrupt the Service, servers, or networks
  • Do not attempt to gain unauthorized access to the Service or user accounts
  • Do not use automated systems or bots to access the Service without permission
  • Do not reverse engineer, decompile, or attempt to extract source code
  • Do not resell or redistribute the Service without authorization

Content Moderation:

All video generation requests are subject to automated content moderation by our AI providers (HeyGen, Google Veo 3, OpenAI Sora 2). Requests violating content policies will be blocked, and repeated violations may result in account suspension or termination without refund.

6. Content Ownership and Intellectual Property

Your Content:

You retain ownership of your input content (prompts, scripts, uploaded images/videos). By using the Service, you grant us a limited, non-exclusive, worldwide license to process and store your content solely for the purpose of providing the Service.

Generated Videos:

Generated videos are subject to the terms of our AI providers (HeyGen, Google, OpenAI). You receive a license to use generated videos for commercial and non-commercial purposes, subject to:

  • Compliance with this Agreement and applicable laws
  • The AI provider's usage terms and restrictions
  • Proper disclosure that content is AI-generated where required by law
  • Not using generated content to train other AI models without permission

AI-Generated Content Disclaimer:

Important: You are solely responsible for:

  • Ensuring your use of generated content complies with all applicable laws
  • Obtaining necessary rights, permissions, and consents for any third-party content
  • Disclosing that content is AI-generated when required by law (e.g., political ads, commercial use)
  • Not using generated videos to harm, defame, or mislead others

We do not claim ownership of your generated videos, but we are not liable for any claims arising from your use of AI-generated content.

7. Service Availability and Performance

We strive to provide reliable service but do not guarantee uninterrupted access or specific performance levels:

  • The Service may be temporarily unavailable for maintenance, updates, or upgrades
  • AI provider availability may affect service functionality
  • Video generation times vary (typically 2-30 minutes depending on complexity)
  • We do not guarantee specific quality, accuracy, or results from AI-generated videos
  • Third-party provider limitations may affect available features

We are not liable for any inconvenience or losses resulting from service interruptions, AI provider outages, or variations in AI-generated content quality.

8. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND:

  • We do not guarantee specific results, quality, or accuracy of AI-generated videos
  • AI-generated content may contain errors, inaccuracies, or unexpected results
  • We do not warrant that the Service will be error-free or uninterrupted
  • We are not responsible for content moderation decisions made by AI providers
  • Generated videos may not meet your specific expectations or requirements

You acknowledge that AI technology is evolving and may produce unpredictable results. You use the Service at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law:

  • Vimu shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Service
  • Our total liability to you for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim
  • We are not liable for any damages arising from your use of AI-generated content, including claims from third parties
  • We are not liable for actions or omissions of third-party AI providers (HeyGen, Google, OpenAI)

10. Indemnification

You agree to indemnify, defend, and hold harmless Vimu and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service or generated content
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Your creation or distribution of prohibited content
  • Claims that your use of AI-generated content infringes or violates third-party rights

11. Account Termination and Suspension

We reserve the right to suspend or terminate your account:

  • For violations of these Terms, especially prohibited content policies
  • For abusive or fraudulent behavior
  • If required by law or legal process
  • At our discretion with or without notice

Upon termination:

  • Your right to use the Service ceases immediately
  • Your unused credits are forfeited (no refund unless required by law)
  • Your generated videos may be deleted after a grace period
  • You may request a data export before deletion

You may terminate your account at any time by contacting support. Unused credits will not be refunded upon voluntary termination.

12. Third-Party AI Providers

Our Service uses third-party AI providers. Your use of the Service is also subject to:

These providers may impose additional restrictions on content and usage. We act as an intermediary and are not responsible for provider-specific limitations or content moderation decisions.

13. Dispute Resolution

In the event of any dispute arising from these Terms or your use of the Service:

  • You agree to first attempt to resolve the dispute informally by contacting us
  • If informal resolution fails, disputes shall be resolved through binding arbitration or small claims court
  • You waive the right to participate in class action lawsuits against Vimu

EU Consumers: This arbitration clause does not affect your statutory rights under EU consumer protection laws. EU consumers may file complaints with their local consumer protection authority.

14. Changes to Terms

We may modify these Terms at any time to reflect changes in our Service, legal requirements, or business practices. We will notify users of material changes by:

  • Email notification to your registered email address
  • Prominent notice on the website or in the Service
  • Updating the "Last updated" date at the top of this page

Continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Italy and the European Union, without regard to conflict of law provisions.

Any legal action or proceeding arising from these Terms shall be brought exclusively in the courts of Italy, and you consent to the jurisdiction of such courts. EU consumers retain their statutory rights to bring claims in their country of residence.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vimu regarding the Service and supersede all prior agreements and understandings.
